Terms of Service

1. Acceptance of Terms

By installing or using NicheIQ (the "Service"), including the NicheIQ Chrome extension and the website at nicheiq.ai, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

NicheIQ is a niche analysis tool for Amazon sellers, delivered as a Chrome extension that opens as a side panel. When you click Capture on a niche page in Amazon's Product Opportunity Explorer, the extension reads the data shown on that page in your own Amazon Seller Central account (such as niche metrics, search terms and top products) and NicheIQ generates AI reports from it. Your account, subscription and reports are managed inside the extension; there is no separate web application. The nicheiq.ai website provides information about the Service.

To use the Service, you need Google Chrome and an Amazon Seller Central account with access to Product Opportunity Explorer. We don't provide Amazon accounts or access to Amazon tools, and the features available on the Service may depend on your marketplace and on what Amazon makes available in your account.

3. Account Registration

• You must provide a valid email address and create a password to use the Service
• You are responsible for maintaining the security of your account credentials
• You must be at least 16 years old to create an account
• One person or entity may not maintain more than one account
• You are responsible for all activity that occurs under your account

4. Plans, Subscriptions & Payments

• NicheIQ offers a Free plan and paid subscription plans (Starter and Pro), billed monthly or yearly. Paid plans are purchased from within the extension
• All payments are processed securely through Stripe
• Prices are displayed and charged in US dollars (USD) and may be subject to applicable taxes
• Subscriptions renew automatically at the end of each billing period (monthly or yearly) unless cancelled before the renewal date
• We do not offer free trials of paid plans
• We may change pricing with at least 30 days' prior notice. Price changes apply to existing subscriptions only from their next renewal

5. Niche Scans & Usage Limits

• Each plan includes a number of niche scans. A niche scan is used each time you capture a new niche; generating reports inside a niche you have already captured does not use a scan
• The number of scans and the features included in each plan are described on our pricing page and in the extension
• Some features, such as the AI Niche Agent chat, are subject to a fair-use monthly limit to protect the Service for all users
• Niche scans have no cash value and cannot be transferred between accounts

6. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Share your account credentials with third parties
• Use automated tools (bots, scrapers) to access the Service beyond the provided Chrome extension
• Resell, redistribute, or sublicense access to the Service without written permission
• Interfere with or disrupt the Service or its infrastructure
• Capture data from Amazon accounts you are not authorized to use, or violate Amazon's terms (including the Amazon Services Business Solutions Agreement) in connection with your use of NicheIQ

7. Amazon & Third-Party Services

NicheIQ is not affiliated with, endorsed or sponsored by Amazon. Amazon and Seller Central are trademarks of Amazon.com, Inc. or its affiliates. Your use of Amazon Seller Central remains subject to your agreements with Amazon, and you are responsible for complying with them. We are not responsible for changes Amazon makes to its services that affect how NicheIQ works.

8. Intellectual Property

The Service, including its design, code, features, and content, is the property of NicheIQ. You may not copy, modify, or distribute any part of the Service without prior written consent.

You retain your rights in the data you capture and in the reports you generate and export from the Service.

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

10. Disclaimers

• The Service is provided "as is" and "as available" without warranties of any kind
• Market data comes from the Product Opportunity Explorer pages you capture in your own Seller Central account. It is provided by Amazon, may be estimated, incomplete or delayed, and NicheIQ does not guarantee its accuracy or completeness
• Reports, scores and chat replies are generated by AI and may contain errors. They are for information only and are not financial, legal or business advice
• We do not guarantee that the Service will result in profitable product selections or business outcomes
• You are responsible for the decisions you make based on information provided by the Service

11. Limitation of Liability

To the maximum extent permitted by law, NicheIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

12. Cancellation & Termination

• You may cancel your subscription at any time. Your subscription stays active until the end of the billing period you have already paid for and does not renew
• We do not provide prorated refunds for unused time, except as described in our Refund Policy
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your right to use the Service ceases immediately. Your data may be deleted after 30 days

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for significant changes that affect your subscription.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or in the extension. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of France. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of France, without prejudice to any mandatory consumer protection rules that apply to you.
