Terms of Service

1. Acceptance of Terms

By accessing or using NicheIQ (the "Service"), including the website at nicheiq.ai and the NicheIQ Chrome extension, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

NicheIQ is a niche analysis platform for Amazon sellers. It consists of a Chrome extension that collects product and search data from Amazon Seller Central, and a web application that processes and displays insights based on that data.

3. Account Registration

• You must provide a valid email address and create a password to use the Service
• You are responsible for maintaining the security of your account credentials
• You must be at least 16 years old to create an account
• One person or entity may not maintain more than one account
• You are responsible for all activity that occurs under your account

4. Subscriptions & Payments

• NicheIQ offers paid subscription plans (Starter and Pro) and one-time credit packs
• All payments are processed securely through Stripe
• Subscription plans renew automatically at the end of each billing period unless cancelled before the renewal date
• Prices are displayed in USD and may be subject to applicable taxes
• We reserve the right to change pricing with 30 days' prior notice. Existing subscriptions will not be affected until their next renewal

5. Credits System

• Certain features consume credits (e.g., niche analysis sessions)
• Credits are included with subscription plans and can also be purchased separately
• Purchased credits do not expire as long as your account remains active
• Credits are non-transferable between accounts

6. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Share your account credentials with third parties
• Use automated tools (bots, scrapers) to access the Service beyond the provided Chrome extension
• Resell, redistribute, or sublicense access to the Service without written permission
• Interfere with or disrupt the Service or its infrastructure
• Violate Amazon's Terms of Service in connection with your use of NicheIQ

7. Intellectual Property

The Service, including its design, code, features, and content, is the property of NicheIQ. You may not copy, modify, or distribute any part of the Service without prior written consent.

You retain ownership of the data you generate and store within the Service (niche analyses, saved sessions, notes).

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

9. Disclaimers

• The Service is provided "as is" and "as available" without warranties of any kind
• NicheIQ does not guarantee the accuracy or completeness of Amazon market data. Data is scraped from publicly available Amazon pages and may contain errors or delays
• We do not guarantee that the Service will result in profitable product selections or business outcomes
• We are not responsible for any decisions you make based on data provided by the Service

10. Limitation of Liability

To the maximum extent permitted by law, NicheIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

11. Cancellation & Termination

• You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your right to use the Service ceases immediately. Your data may be deleted after 30 days

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for significant changes that affect your subscription.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through an in-app notice. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of France. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of France.
